Terms of Use

These Terms of Use specify permitted use of the GoExam platform and supplement the General Terms and Conditions of GoExam Labs GbR. They do not create an independent contractual relationship and apply only together with the validly incorporated T&C.

§ 1 General Provisions and Relationship to the T&C

Scope: These Terms of Use govern the concrete use of the online platform operated by GoExam Labs GbR, Friedrich-Ebert-Straße 23, 63225 Langen, at https://www.goexam.de.
Contractual framework: The legal contract exists exclusively under the T&C. These Terms of Use do not create separate payment or service claims.
Priority rule: In case of conflict between the T&C and these Terms of Use, the T&C prevail.
Amendments: GoExam may amend these Terms of Use with effect for the future. Material changes are communicated before they take effect.

§ 2 Access and User Account

Account requirement: Platform use requires a personal account created through registration and acceptance of the T&C and Terms of Use.
Credentials: Login credentials must be kept confidential and may not be shared with third parties. Sublicensing or shared account use is prohibited.
Misuse notification: Users must inform GoExam immediately if there are indications of account misuse. In such case, GoExam may temporarily block the account.
Usernames: Usernames must not contain unlawful, misleading, insulting, discriminatory, or advertising content.
Bypassing suspensions: Creating a new account after permanent suspension is prohibited.

§ 3 Scope of Services (User Perspective)

Usage models: GoExam provides different plans, especially GoExam Free and GoExam Teacher.
Free plan: The Free plan is free of charge but functionally and quantitatively limited (e.g., number of tasks/exams).
Teacher plan: The Teacher plan requires a paid subscription under the T&C and provides an extended feature scope.
Service scope: The specific service scope is defined by the current service description on the GoExam website. There is no entitlement to specific features. GoExam may change, develop, limit, or discontinue features where reasonable.

§ 4 Content and Copyright (User Responsibility)

User responsibility: Users are solely responsible for content they upload or publish in the public pool and must perform reasonable legal checks before publication, especially regarding copyright, trademark, and data protection rights.
No pre-screening: GoExam does not generally pre-check user content for legality, correctness, or license compliance.
Prohibited content: Content that is unlawful, discriminatory, racist, glorifies violence, obscene, or otherwise ethically objectionable is prohibited.
Indemnification: Users must indemnify GoExam from third-party claims arising from unlawful or contract-violating user content, including reasonable legal defense costs.
Copyright allocation and usage rights are further governed by § 8 of the T&C.

§ 5 Fair Use and Code of Conduct

Principle: The platform must be used appropriately, for intended purposes, and fairly.
Technical integrity: Any action that can harm platform stability or security is prohibited, including automated/scripted access (bots, crawlers, scrapers), malware upload/distribution, circumvention of technical protections, and infrastructure-overloading actions (e.g., denial-of-service attempts).
Content and social standards: Users must behave lawfully and respectfully. Prohibited are spam/advertising use, unlawful/abusive/discriminatory/pornographic content, unauthorized attempts to access other user accounts, and use to circumvent school or examination rules.
No entitlement to unrestricted use: There is no entitlement to ongoing unrestricted access to specific features where limits result from misuse or non-contractual use.

§ 6 AI Use and Responsibility

AI features: GoExam provides features based on automated processes and AI, especially for support in creating, structuring, analyzing, or evaluating tasks and exam content.
Supportive nature: AI functionality only supports users and does not replace professional, pedagogical, or legal review.
No guarantee of output quality: GoExam does not guarantee correctness, completeness, timeliness, pedagogical suitability, or legal compliance of AI-generated/supported outputs.
User responsibility: Final selection, use, publication, and practical application of AI-supported content remain solely with the user, including compliance with applicable school and exam rules.
Opt-out: Use of created content for AI training can be objected to at any time according to § 8 of the T&C.

§ 7 No Automated Grading or Assessment

No automated examination decisions: GoExam does not automatically conduct, administer, or decide examinations, grading outcomes, or pass/fail decisions.
Non-binding suggestions: Any displayed ratings, point distributions, solutions, sample solutions, difficulty assessments, or didactic hints are non-binding assistance only.
No legal or school-law binding effect: GoExam features do not replace the responsibility, decision-making, or supervision of teachers, examiners, or other responsible authorities.

§ 8 Publication and Licenses (Public Pool)

Public publication: Content published in the public pool is addressed to the general public.
Licensing prerequisite: Publication requires that the user holds necessary rights and correctly applies GoExam's provided license models (e.g., Creative Commons).
Copyright exceptions: Legal exceptions (e.g., quotation rights) and teaching exceptions generally do not apply to public publication addressed to the general public.
Reversal limitations: Complete withdrawal of already published content cannot be guaranteed.

§ 9 Support Disclaimer

GoExam provides support/help resources (e.g., via support@goexam.de) voluntarily. There is no entitlement to specific response times or availability. § 7.6 of the T&C applies additionally.

§ 10 Sanctions for Violations

Measures for violations: In case of violations, GoExam may block or remove content. Illegal content can be reported to meldung@goexam.de. Reports must not be abusive.
Handling of reports: GoExam reviews reported content and decides on suitable measures within a reasonable period. If GoExam gains knowledge of potential infringement, it will review and, where necessary, block or remove content in line with legal requirements.
Serious/repeated violations: GoExam may apply T&C measures, including account suspension or extraordinary termination.
Further contractual measures are governed by § 10 of the T&C.

§ 11 Data Protection in the Usage Context

Processing of personal data is governed by the GoExam Privacy Policy.
Users must not process or publish third-party personal data (especially student data) without legal basis or authorization.
In institutional use, requirements of the responsible institution (e.g., school authority) must be followed. Data processing provisions under § 9 of the T&C apply additionally.

§ 12 Consequences of Contract Termination

Consequences of contract termination, especially regarding data access, restrictions, and deletion, are governed exclusively by § 3.4 of the T&C.
These Terms of Use do not create additional claims beyond that.
